Remembering the past to shape the future: Australian vaping regulation

The emergence of e-cigarettes as a new mode of nicotine consumption brought with it many perspectives on how vaping should be understood and regulated. A 2021 Therapeutic Goods Administration regulatory framework positioned e-cigarettes as a smoking cessation device accessible only through prescription and personal overseas importation. Yet unregulated markets continued to operate outside this framework, leaving those using e-cigarettes illicitly at risk of criminal penalty. The growth of unregulated markets prompted additional legislation to close these markets and, as a consequence, further increased the criminalisation risk for individuals possessing illicit e-cigarettes. This presentation explores advocacy undertaken by the Australian Alcohol and other Drugs Council to reduce the criminalisation risk for e-cigarette users and ensure that, although change in the AOD landscape is constant, policy does not forget lessons of the past.
